These Terms and Conditions (“Terms”) govern the use of Shawn’s Tree Care services and outline the rights, responsibilities, and obligations between Shawn’s Tree Care (“we,” “us,” or “our”) and the customer (“you” or “client”). By scheduling services with Shawn’s Tree Care, you agree to comply with and be bound by these Terms.


1. Scope of Services

Shawn’s Tree Care provides professional tree care services, including but not limited to:


• Tree removal

• Tree pruning and trimming

• Bush and tree planting

• Stump grinding

• Land clearing

• Tree cabling and bracing

• Emergency storm damage cleanup

Additional Work: Any work outside the scope of services outlined in the initial estimate or agreement will require a separate written agreement or approval before proceeding.



2. Payment Terms

Estimates and Quotes:

All estimates provided are valid for 30 days from the date issued unless otherwise specified. Quotes are based on the information provided by the client and an on-site assessment. Any changes to the scope of work may result in an updated estimate.

Deposit Requirements:


 • A deposit may be required before work begins, depending on the size and scope of the project.

• Deposits are non-refundable once materials or equipment have been allocated for the project.

Final Payment:


• Full payment is due upon project completion unless other arrangements are made in writing.

• Accepted forms of payment include cash, check, and electronic payment methods (e.g., credit cards).

Late Payments:


 • Payments not received within the completion date will incur a late fee.



3. Liability and Limitations

Customer Responsibilities:


• The customer is responsible for providing accurate information about the property and any underground utilities, such as sprinkler systems or septic tanks.

• Shawn’s Tree Care is not liable for damages to concealed underground utilities not disclosed by the customer.

Damage Limitations:


• We take every precaution to protect your property. However, we are not liable for:

• Damage caused by storm-damaged trees or unpredictable hazards.

• Damage to landscaping, structures, or utilities resulting from undisclosed information.

Force Majeure:


• Shawn’s Tree Care will not be held responsible for delays or damage caused by factors outside our control, including extreme weather, natural disasters, or unforeseen circumstances.



4. Cancellations and Rescheduling

Customer-Initiated Cancellations:


 • Cancellations made before the scheduled service date may be eligible for a refund of the deposit, less any incurred costs.

 • Cancellations made less than 24 hours before the scheduled service date will result in the forfeiture of the deposit.

Rescheduling:


 • Customers may request to reschedule services at least 24 hours in advance. Rescheduling is subject to availability.

Company-Initiated Cancellations:


• We reserve the right to reschedule or cancel services due to unsafe working conditions, such as weather hazards or access limitations. In such cases, we will make every effort to accommodate the client with a new service date.



5. Dispute Resolution

In the event of a dispute between Shawn’s Tree Care and the customer:


Good Faith Resolution: Both parties agree to attempt to resolve disputes amicably through written communication and negotiation.

Mediation or Arbitration: If an agreement cannot be reached, disputes may be submitted to mediation or arbitration, with costs shared by both parties.

Governing Law: This agreement is governed by the laws of the State of New York.



6. Intellectual Property

All content on the Shawn’s Tree Care website, including text, images, and graphics, is the property of Shawn’s Tree Care and is protected under copyright law. Unauthorized use, reproduction, or distribution of this content is strictly prohibited.



7. Changes to Terms and Conditions

Shawn’s Tree Care reserves the right to update or modify these Terms and Conditions at any time. Customers will be notified of significant changes, and the most current version will always be available on our website.
